Collection of Personally Identifiable Information

The Y collects personally identifiable information (PII) from you when you voluntarily submit such information to us. The collection of PII may occur in person or on a website or mobile application operated, provided or otherwise controlled by The Y. This information may include your name, home address, email address, telephone number, date of birth, demographic information, sex offender status, membership status, emergency contact information, and other information that we may need to collect in connection with certain events, including but not limited to:

  • registration for, or participation in, events, classes, camps, and other activities or programs offered by The Y;
  • participation in YMCA Nationwide Membership
  • registration for surveys, forums, content submissions, chats, bulletin boards, discussion groups, requests for suggestions, or other services or activities offered on our website;
  • answering your inquiries about our websites, organization, membership, or other services or activities;
  • registration as a member of The Y

Use and Disclosure of PII

If you do provide us with PII, The Y may contact you based on the information you provide to communicate with you about YMCA activities that may be of interest to you and your family. If you provide your email or phone number via an online web form, you agree to receive email and/or SMS updates about the YMCA of Madison County. The frequency may vary. Message and data rates may apply.

The Y will use its best efforts to never disclose any PII about you to any third party for purposes unrelated to the YMCA without having received your permission except as provided for herein or otherwise as permitted or required under applicable law.

We do not rent or sell PII, including information provided about children, to third parties. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. The Y may share PII with trusted service providers, such as payment processors, technology partners, or other providers that need access to your information to provide operational or other support services while you are a YMCA member or program participant. In certain circumstances, we may also share information with select similar nonprofit organizations that may offer activities of interest to you.

We may also provide PII to regulatory authorities and law enforcement officials per applicable law or when we otherwise believe in good faith that the provision of such information is required or permitted by law, such as in connection with the investigation or assertion of legal defenses or for compliance matters.

In communicating directly with minors over the Internet, we recognize the unique issues raised regarding the protection of your child's privacy. The Children's Advertising Review Unit (CARU), a section of the Better Business Bureau, has issued guidelines for websites gathering information from minors. The YMCA of Madison County intends to comply with the CARU guidelines to protect your kids and their privacy. We recommend, however, that you caution your children on the importance of scrutinizing sources and checking with you before revealing any personal information.

 

Your Ideas

We encourage you to share your comments and questions with us. We promise to read all the mail you send to us, but we may not be able to respond to all of it. However, please note that we assume no responsibility for reviewing unsolicited ideas for our business (like product or advertising ideas) and will not incur any liability as a result of any similarities between your ideas and future YMCA of Madison County programs. This means that we have no obligation to treat your idea submissions confidentially and that we can use them without paying you for them. All idea submissions will be owned by the YMCA of Madison County exclusively and may be used by the YMCA of Madison County for any purpose, now or in the future.


Donors

Contributions made to the YMCA of Madison County are acknowledged in our Annual Report. Donors who do not wish to have their names recognized in print and online can request to remain anonymous at the time of pledging. Donors may also opt-out at any time of involvement in future campaigns and mailing lists.


Indemnity

You agree to defend, indemnify and hold us harmless, and our officers, directors, employees, agents and vendors, from and against all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) any breach by you of any of these terms and conditions, (ii) your content and materials, (iii) your use of materials or features available on the website (except to the extent a claim is based upon infringement of a third party right by materials created by us) or (iv) a violation by you of applicable law or any agreement or terms with a third party to which you are subject.


Jurisdictional Issues

We control and operate this website from our offices in the United States of America. We do not represent that materials on the website are appropriate or available for use in other locations. Persons who choose to access this website from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.


Miscellaneous

These terms will be governed by and construed following the laws of the State of Indiana, without regard to any principles of conflicts of law.
